Terms and Conditions

These Terms and Conditions (“Terms”) apply to Your (“You” or “Your” or “User”) or Event Creator access and use of the Vande Mataram 150 Portal (collectively referred to as “Vande Mataram 150” or “Platform” or “Website” or “We” or “Our”).

YOUR AGREEMENT TO THE TERMS

This document is an electronic record in terms of the Information Technology Act, 2000, and published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the Platform.

Your use of the Platform and tools are governed by the following Terms as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You interact with the Platform, You shall be subject to the policies that apply to the Platform for such interaction. These Terms including without limitation the Privacy Policy that govern Your use of the vandemataram150.in and constitute a legal contract between You and the Platform.

Please read these Terms carefully. Your access or use of the Platform signifies that You have read, understood, and agreed to be bound by, without limitation or qualification, the terms. You will not use the Platform for any purpose that is unlawful or prohibited by these Terms and Conditions.

By accessing or using the services as a User You also represent that You have the legal authority to accept the terms on behalf of yourself and any party You represent in connection with Your use of Vande Mataram 150. If you do not agree to the terms, kindly discontinue Your use of the Website. Any breach of these Terms immediately terminates Your right to access and all rights and licenses granted to You by these Terms.

These Terms pertains only to the website vandemataram150.in and do not concern any other website or Internet-based services.

DEFINITION

The definitions provided in these Terms are intended for clarification and understanding of the terms used herein. In the event of any dispute or disagreement arising from the interpretation of the definitions contained herein, such disputes shall be conclusively settled in accordance with the understanding and interpretation of the Platform.

  • i. Content: any data, text, images, audio, video, or other material that is uploaded or generated on the Platform.
  • ii. Cookies: Cookies are small text files stored on your device (computer, tablet, smartphone) when you visit a website. They are widely used to make websites work more efficiently and to provide data to the owners of the site.
  • iii. Data: any information, including but not limited to personal data, user- generated content, usage data, cookies, metadata, and any other information collected, processed, or stored by the Platform during the use of its Website. This includes information provided by Users during registration, interactions with the platform's features, communication with other Users, and any other activity performed on the Platform. Additionally, "Data" may also include information collected through automated means such as cookies, log files, and analytics tools to enhance the User experience, and improve the performance and security of the Platform.
  • iv. Event Creator(s): Event creators may include State / Ministry / College / School / Institute/departments.
  • v. User: any individual who accesses or uses the Platform, including but not limited to users, visitors, and individuals interacting with the Platform's features, or content.

2. ABOUT THE INITIATIVE

The year 2025 marks the 150th anniversary of “Vande Mataram”, a timeless national song that inspired generations of freedom fighters and symbolized India’s collective consciousness during the independence movement.

To commemorate this milestone, the Ministry of Culture, Government of India has launched this initiative with the sole purpose to celebrate the song’s historic, cultural, and emotional significance through interactive content, events, galleries, and citizen participation. Users are invited to record and sing Vande Mataram.

3. PARTICIPATION GUIDELINES

  • 3.1. The initiative is open to anyone willing to participate in this initiative.
  • 3.2. The User may participate by uploading their recording upon completion of OTP verification through their registered mobile number or email ID. The OPT maybe received via WhatsApp/SMS/Email.
  • 3.3. Uploads and Submissions:
    1. a. Users may select or listen to theme and practice singing using available audio files.
    2. b. Recording: Users may select “Record My Rendition,” choose their preferred language, and use the embedded karaoke player to sing along with the Vande Mataram instrumental audio.
    3. c. Microphone and camera access will be enabled for recording, with a waveform visualizer or timer displayed during recording.
    4. d. Users can reset the video if necessary.
    5. e. DIC may, at its discretion, review and moderate all videos uploaded to the Platform using any means including AI tools. Content not meeting the requirements of MoC may be rejected and withheld from publication. The decision of DIC in this regard shall be final.
    6. f. Post-Recording Uploads: Users can upload one picture post-submission, subject to the maximum limit.
    7. g. Certificates and Display: An auto-generated digital participation certificate (PDF) will be issued upon submitting the entry.

4. Event Creators

  • 4.1 Event Creators shall register and create a profile using mobile number or email ID verification through a one-time password (OTP) before creating or uploading an event.
  • 4.2 The profile will show the past events created by the Event Creators.
  • 4.3 Event Details to Capture: The Event Creators will have the option to specify if the event is ‘Upcoming’ or ‘Completed’.
    1. i) If event is completed - The details shall include Title, Date, Time, Location, Description, Picture, Video(s), and No. of Participants; and
    2. ii) If event is upcoming - Title, Date, Time, Location, Description. The Picture, Video(s), and No. of Participants will be added later by the Event Creator.

5. CODE OF CONDUCT

  • 5.1 User or Event Creators agrees to comply with all applicable laws, rules, and regulations and agrees not to:
    1. a. Use the Platform for any unlawful purpose or violate someone else's rights, this includes but is not limited to harassment or bullying, breach of privacy, or any action that jeopardizes the safety or privacy of minors.
    2. b. Engage in spamming, impersonate any person or entity, whether actual or fictitious or harvesting of data about Platform Users.
  • 5.2 User or Event Creators Responsibility:
    1. a. Users or Event Creators must keep their details confidential and must not voluntarily disclose any confidential data to third parties.
    2. b. By using the Platform, the User acknowledges and agrees to act responsibly while sharing any data with any Event Creator, whether on the Platform or in a personal capacity.
    3. c. Users must ensure the accuracy of their personal data provided to the Platform.
    4. d. Users or Event Creators must not transmit unlawful, defamatory, obscene, offensive, or scandalous material via Platform.
    5. e. Providing incomplete, inaccurate, or false data via Platform may result in suspension or termination of access.
    6. f. The User or Event Creators shall only share such data with the Platform that are required for the intended purpose and shall refrain from disclosing any additional personal data.
    7. g. Platform hereby absolves itself of any liability arising from the actions or conduct of the Event Creators, whether occurring online or offline. Users are advised to consult the individual policies of Event Creators, as they operate under their own terms.
    8. h. Any content created/posted on the Platform, will be the intellectual property of the Platform.

6. OWNERSHIP OF CONTENT AND GRANT OF CONDITIONAL LICENSE

  • 6.1 The Platform and all its content are owned by the Ministry of Culture. The Users and Event Creators expressly authorizes the Platform to reproduce and use the uploaded video, the User’s name, image and other attributes of the Users appearing in the video, as well as any other image or content contained in the video or the images of the event or associated links for editorial, promotion and other purposes related to the initiative in any medium, including the Internet and social media channels, without such activities granting the User right to compensation or any benefit.
  • 6.2 Users and Event Creators are granted a conditional license to view the Platform and share its Content for non-commercial purposes only, subject to certain restrictions that are listed below. Users or Event Creators will not:
    1. a. Submit any video, audio or other materials that include viruses, worms, Trojan horses, defects, malware, or any other items of a destructive nature.
    2. b. Manipulate identifiers, including by forging headers, to disguise the origin of any posting that you submit. "Frame" or "mirror" any part of the platform.
    3. c. Link to any portion of the Website other than the URL assigned to the homepage of the Platform.
    4. d. Modify, adapt, sub-license, translate, sell, reverse engineer, decompile, or disassemble any portion of the platform, or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Content.
    5. e. Remove any copyright, trademark, or other proprietary rights notices contained on the Platform.
    6. f. Use any computer program, bot, robot, spider, offline reader, platform search/retrieval application, or other manual or automatic device tool, or process to retrieve, index, data mine, or in any way reproduce or circumvent the security structure, navigational structure, or presentation of the content or the Platform.
    7. g. Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.
    8. h. Reproduce, modify, display, publicly perform, distribute, or create derivative works of the Platform or the Content.
    9. i. Engage in any activity that seeks to bypass or undermine the technological measures put in place to control access to the Platform and its Content. Such actions performed either by Users or Event Creators themselves or through any third-party entity whether done manually or through automated means, are strictly prohibited and are not permissible on the Platform.
  • 6.3 The trademarks, logos, and service marks (collectively, the “Trademarks”) of Platform, whether registered or unregistered, are the intellectual property of the Platform owner or licensed to the Platform owner. Unauthorized use of the Trademarks, including reproduction, imitation, dilution, or confusing or misleading uses, is strictly prohibited and may constitute a violation of the trademark laws. Use of the Trademarks without the platform owner’s express written consent is not permitted. Any such unauthorized use may result in appropriate legal action.

7. COMMUNITY GUIDELINES

These guidelines apply to all types of content on the Platform, including unlisted and private content, links, community posts etc. If Your content violates Our community guidelines then appropriate action will be taken.

  • 7.1 Respect and Tolerance:
    1. a. Harassment and Bullying: These Terms protects Users from harassment and bullying. Please avoid any behaviour that can be attributed as harassment including sexual harassment and bullying or any other form of activities consisting coercion or use of force.
    2. b. No Hate Speech: Avoid offensive language, discrimination, harmful comments, or any kind of expressions that advocate incitement to harm, including acts of discrimination, hostility, radicalization, ethnicity, victims of a major violent event (and their kin) and verbal or physical violence.
    3. c. No Nudity or Profanity: Users must not post or share any content that contains nudity, sexual acts, or any other form of explicit sexual content. Sexually explicit content featuring minors and content that sexually exploits minors is not allowed on Platform.
  • 7.2 Accuracy and Authenticity:
    1. a. Fact-checking: Verify data before sharing.
    2. b. Avoid Rumours: Refrain from spreading unverified news.
  • 7.3 Safety and Privacy:
    1. a. Privacy Awareness: Protect your data; avoid sharing any sensitive details.
    2. b. Report Abuse: Notify support of any cyberbullying or harassment.
  • 7.4 Legal and Ethical Boundaries:
    1. a. Compliance: Abide by local, national, and international laws.
    2. b. No Harmful Content: Avoid promoting violence, illegal activities, or harm.
    3. c. Respect Copyright: Give credit for the Content you share.
  • 7.5 Non-Political and Non-Religious Content:
    1. a. Avoid Politics: Refrain from discussing political parties or ideologies.
    2. b. Religious Neutrality: Refrain from discussing or mentioning religious ideologies.
  • 7.6 Community Moderation and Reporting:
    1. a. Moderators: Enforce guidelines consistently.
    2. b. User Reporting: Report inappropriate content promptly.
    3. c. Consequences: Violations may lead to termination of access to the Platform.
  • 7.7 Impersonation:
    1. a. Content intended to impersonate a person and or provide misinformation about your own self is not allowed in Platform.
    2. b. Using name, user name for the Event Creator profile, image, brand, logo, or other personal data that is inaccurate and is done with a malafide intention to impersonate others is not allowed.
  • 7.8 Spam, misleading metadata, and Deceptive practice:
    1. a. Platform doesn’t allow spam, scams, or other deceptive practices that take advantage of the Users or Event Creators involved in Platform.
    2. b. Leaving large amounts of identical, untargeted, or repetitive data.
  • 7.9 Misinformation:
    1. a. Don’t post content that has been technically manipulated or doctored in a way that misleads the Platform and may pose a serious risk of egregious harm.
    2. b. Don’t post content that may pose a serious risk of egregious harm by falsely claiming that old footage from a past event is from a current event.

8. DISCLAIMER

  • 8.1 Your access to and use of the features or any Content are at your own risk. You understand and agree that the features are provided to you on an “AS IS” and “AS AVAILABLE” basis.
  • 8.2 Without limiting the foregoing, to the maximum extent permitted under applicable law, Platform DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Platform makes no warranty or representation and disclaims all responsibility and liability for (i) the completeness, accuracy, availability, timeliness, security or reliability of the features or any Content; (ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of the features or any Content; (iii) the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the features; and (iv) whether the features will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
  • 8.3 Users or Event Creators are solely responsible for their actions, interactions, and contributions on the Platform. The Platform does not endorse or verify the accuracy of any content generated by Users or Event Creators.
  • 8.4 Users acknowledge that sharing personal data with any third party, including but not limited to, OTPs, Mobile number, or other details, is at their own risk. Platform shall not be responsible for any consequences resulting from such disclosures.
  • 8.5 The Platform, its administrators, and affiliated partners shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from User or Event Creator’s actions or outcomes. This includes but is not limited to:
    1. a. Loss of data, opportunities, or profits
    2. b. Harm caused by reliance on Platform Content
    3. c. Disruptions or errors in Platform functionality
    4. d. Disruption in network connectivity.

9. LIMIT OF LIABILITY

Platform shall, in no event, be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with User’s or Event Creator’s use of the Platform, or for any information or materials available through the Platform. Platform shall not be liable or responsible for any claim, damage, or loss resulting, directly or indirectly, including, but not limited to failure of electronic or mechanical equipment or communication lines, telephone, or other connection problems.

10. TERMINATION/BLOCKING/RESTRICTION OF ACCOUNT

  • 10.1 Platform reserves the right to terminate the access to Platform in the event of violations of these Terms and Privacy Policy. Such violations include, but are not limited to breaches of the code of conduct, copyright policy, mandates of uploads, etc.
  • 10.2 Platform reserves the right to suspend or terminate User’s access to the features or delete the profile in case of Event Creators if required to do so to comply with a legal requirement or a court order;

11. VIOLATION OF THE TERMS

Platform reserves the right to investigate any alleged or suspected violations of these Terms. If a breach is determined, Platform may take appropriate legal actions, which may include, but is not limited to, the temporary suspension of access to the Platform, the removal of Content that is deemed offensive or in violation of these Terms, and the blocking of Event Creator’s profile. These measures are taken to maintain the integrity and safety of the Website, Event Creators and its Users.

12. COPYRIGHT

User’s and Event Creator’s access to and use of Platform, along with its Content, is governed by the Terms agreed upon at the time of Your OTP verification. These Terms include disclaimers of warranty, directives for linking to external websites, and disclaimers related to such links.

Platform grants Users and Event Creators a ‘non-exclusive’ and explicit right and license over the Content for editorial, marketing, and promotional purposes. When any material from Platform is published or distributed, the source of the material must be clearly and prominently cited.

The permission granted to use Platform’s material does not extend to any Content that is marked as copyrighted by a third party. User’s and Event Creator’s use of Platform shall not grant them any claim of ownership over any Content. Reproduction of such Content shall be subject to the limitation of sharing it over the social media.

13. INDEMNITY

User and Event Creator hereby agree to indemnify and hold Platform harmless from and against all liabilities, damages, losses, and expenses of any kind (including reasonable legal fees and costs) relating to, arising out of, or in any way in connection with access to or use of the features of the Platform, including data and Content provided in connection therewith, breach of the Terms or applicable law; or any misrepresentation made by User or Event Creator.

14. UPDATE/MODIFICATIONS IN THE TERMS

Platform reserves the right to update or modify (without limitation) these Terms at any time. These updates may be necessary due to legal requirements, technological advancements, or changes in the Platform’s features. We are committed to keeping Users and Event Creators informed about any modifications.

If any material changes are made in the Terms and Conditions, the Users and Event Creators will be notified by us, to provide an opportunity to review the changes before they become effective. User’s and Event Creator’s continued use of Our Platform after We publish or send a notice about Our changes to these Terms means that Users and Event Creators are consenting to the updated Terms as of their effective date.

15. SEVERABILITY

If any of these Terms/Privacy Policy should be determined to be illegal, invalid, or otherwise unenforceable, it/they shall be severed and deleted from these Terms, and all other terms and/or conditions shall remain in full force and continue to be binding and enforceable.

16. ENTIRE AGREEMENT

Without prejudice to your or our rights in respect of fraud or fraudulent misrepresentation, these Terms constitute the entire understanding and agreement between Users/Event Creators and Us regarding the subject matter of these Terms and supersede all prior and contemporaneous agreements and understandings between you and us regarding the subject matter of these Terms.

17. TERMINATION

If Users/Event Creators are in material breach of these Terms We may (in our sole discretion): (i) suspend, limit the access to, or terminate the use of the Platform; and/or (iv) In case of Event Creators suspend, limit the access to or terminate the profile with immediate effect.

If We terminate the use of the Platform, We may delete from Our servers (and from the Platform) any information or materials relating to the Users/Event Creators (and/or their use of the Platform) subject to Our requirements under the applicable laws including Information Technology Act, 2000 and Digital Personal Data Protection Act, 2023, and any retention requirements as set out in these Terms.

21. FORCE MAJURE

Notwithstanding any provision contained in these Terms, neither Parties shall be liable to the other to the extent that the fulfilment or performance of any terms and conditions is delayed or prevented by revolutions, civil disorders, wars, acts of enemies, strikes, lack of available resources from persons other than the Parties to this Terms, electrical equipment availability or failure, fires, floods, rainfall, snowfall, earthquake, natural calamity, pandemic, central, state or municipal action, statute, ordinance, or regulation or without limiting the foregoing, any other cause not within its control and which by the exercise for reasonable diligence, it is unable to prevent, whether of the class of causes hereinbefore enumerated or not. If any force majeure event occurs, the affected party shall promptly give a written notice to the other Party and shall use reasonable effects to minimize the impact of such event.

22. GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION

This Terms and Conditions/Privacy Policy is subject to and shall be governed by and construed in accordance with the laws of India, with the competent Courts in New Delhi having exclusive jurisdiction.

In the event of any dispute, controversy, or claim arising out of or relating to this Terms of Service, including its formation, interpretation, performance, or breach, the dispute shall be referred to and finally resolved by arbitration.

The place and seat of arbitration shall be New Delhi and the language of the arbitration proceedings shall be English. The arbitration tribunal shall consist of a sole arbitrator mutually appointed by the Parties in accordance with the provisions of the Arbitration and Conciliation Act, 1996.
